These Terms apply to the CHAMA website located at hellochama.com (the "Site") and the CHAMA mobile applications available on the Apple App Store (iOS, iPadOS, watchOS) and Google Play Store (Android) (the "Apps"). The Site and Apps are owned and operated by HSCO (SIREN 879 661 130), located at 113 rue du Chemin Vert, Paris, France ("CHAMA", "we", "us", "our", "platform"). By accessing the Site and/or downloading, installing or using the Apps, you agree to be bound by these Terms and our Privacy Policy. What we do. CHAMA provides an AI-powered coaching experience for training and fitness, which may include training plans, workouts, progress tracking, performance and recovery guidance, and educational content (the "Services"). Eligibility. You must be 18 years or older to use CHAMA. We may suspend or delete accounts we reasonably believe are used by individuals under 18. Account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate and up-to-date information.
CHAMA uses automated systems (including AI models) to generate recommendations and content. You acknowledge that AI outputs may be inaccurate, incomplete, or not appropriate for your circumstances. You remain solely responsible for deciding whether and how to follow any training, nutrition, hydration, supplement, or recovery suggestions; using safe technique and judgment; and stopping activity if you feel pain, dizziness, discomfort, or any concerning symptoms.
The Services are provided for informational and educational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment, or for individualized coaching by qualified professionals. CHAMA does not provide medical, physiotherapy, or clinical nutrition services. Using CHAMA does not create a doctor-patient or other healthcare relationship. If you have a medical condition, are pregnant, take medication, have an eating disorder history, or have any health concerns, you should consult a qualified professional before using the Services or starting/changing an exercise or nutrition routine.
We may update the Apps to add features, improve performance, or fix bugs. You may need to install the latest version to keep using the Apps. We do not guarantee uninterrupted or error-free operation. Availability may be affected by factors outside our control (network, devices, store outages). We may modify, suspend, discontinue, or remove parts of the Services at any time for operational, security, legal, or product reasons.
The Apps may integrate with third-party services (e.g., Strava, Garmin, Apple Health, Google Fit). These services are not controlled by us and may change or become unavailable. We are not responsible for third-party services or any issues caused by them. Your use of third-party services is subject to their own terms and policies.
We may offer support via email and/or in-app messaging. Responses may be provided by our team and/or automated systems. You agree not to send spam or excessive messages; send abusive, defamatory, threatening, harassing, hateful, exploitative, or discriminatory content; or attempt to extract system prompts, reverse engineer, or misuse AI features. We may restrict or suspend access to messaging or the Services if we believe you breach this section.
CHAMA provides AI-powered features which require significant computing resources. To protect the quality of the Services for all users and to prevent abuse, we apply a fair usage policy to AI consumption. Fair usage threshold. Your access to AI features is intended for normal personal use. From an estimated usage of 1,000,000 tokens per calendar month (or equivalent compute usage as measured by us), we reserve the right, at our sole discretion, to temporarily limit your access to certain AI features; request that you reduce usage; and/or suspend or terminate your account in accordance with these Terms. How we measure usage. Token usage is an internal estimate based on your interactions with AI features (including prompts and responses). Our measurement and interpretation of token usage is final for the purpose of applying this policy. No circumvention. You must not attempt to circumvent usage controls or limits, including by creating multiple accounts, using automation, rotating IPs/devices, or any other method designed to increase access to AI features or bypass our security measures.
You may use the Services only for personal, non-commercial use and in compliance with applicable laws. You must not (and must not attempt to): copy, modify, translate, reverse engineer, decompile, disassemble, or create derivative works from the Site/Apps/Services; access the Services through automated means (bots, scrapers) except where expressly allowed; circumvent paywalls, access controls, or usage limits; interfere with security or performance; or use the Services for unlawful purposes or to infringe others' rights.
You may provide information and content (e.g., profile inputs, notes, messages) ("User Content"). You retain ownership of your User Content. You grant us a limited, worldwide, non-exclusive license to host, store, process, reproduce and display User Content solely to operate and improve the Services and provide support, in accordance with our Privacy Policy.
CHAMA may offer paid subscriptions ("Subscription") and may offer free trials from time to time. Subscriptions may be available on monthly and/or annual terms and may auto-renew unless cancelled. Trials, discounts, and promotions (if offered) may be limited (e.g., first-time users only) and may be withdrawn at any time.
Apple App Store / Google Play purchases. If you purchase a Subscription via Apple or Google, the store processes payment and manages your subscription under its terms. You must manage cancellation and renewal in your store account settings. Unless required by applicable law or store policy, CHAMA does not provide refunds for store-billed subscriptions. Price changes. We may change pricing; where required, we will provide notice.
You agree to comply with the Apple Media Services Terms and Conditions and Google Play Terms of Service (as applicable). You acknowledge that the availability of the Apps depends on the store from which you downloaded them; these Terms are between you and us, not Apple or Google; and Apple and Google (and their subsidiaries) are third-party beneficiaries of these Terms.
The Site, Apps, Services and all related content (including software, text, graphics, logos, and designs) are owned by us and/or our licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for personal use in accordance with these Terms.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE, APPS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW: WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF: (A) EUR 100, OR (B) THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE EVENT. You acknowledge that physical training carries inherent risks (including injury). You voluntarily assume all risks associated with your activities.
You agree to indemnify and hold harmless us and our affiliates, officers, employees, contractors and licensors from any claims, damages, liabilities and expenses arising from your breach of these Terms, misuse of the Services, or violation of laws or third-party rights.
We may suspend or terminate your access to the Services if we believe you breach these Terms, create risk, or where required for legal or security reasons. You may stop using the Services at any time. If you cancel a store subscription, you will retain access until the end of the current billing period.
We may update these Terms from time to time. The "Last Update" date indicates when changes were made. Your continued use of the Services after changes become effective means you accept the updated Terms.
Electronic communications. You consent to receive communications electronically. Assignment. We may assign our rights and obligations under these Terms. Severability. If any provision is invalid, the remainder remains in effect. Entire agreement. These Terms and referenced policies are the entire agreement between you and us.
These Terms are governed by the laws of France. If a dispute arises, you agree to first contact us at [email protected] and attempt to resolve it in good faith. Subject to mandatory consumer protection rules, disputes will be submitted to the competent courts of Paris, France.

We collect information to provide you with the Services, personalize your coaching experience, operate and secure our platform, and improve the user experience.
2.1 Categories of personal data, purposes, and lawful basis (GDPR)
1. Account & profile data. Name or display name, email address, password hash, age/date of birth or age confirmation, optional profile photo, optional gender.
Purpose: Create and manage your account; provide the Services; communicate with you about service messages, technical updates, and support.
Lawful basis: Contract; Legitimate interests (support, security).
2. Fitness profile data. Goals, training preferences, experience level, schedule, optional injury/limitations you choose to provide.
Purpose: Personalize training plans and coaching guidance; adapt recommendations.
Lawful basis: Contract; and where required, Explicit consent (if treated as sensitive data).
3. Workout & performance data. Workouts, distance, duration, pace, cadence, splits, session timestamps, notes, perceived effort, and similar training metrics.
Purpose: Provide training history, progress tracking, insights, and personalized coaching.
Lawful basis: Contract.
4. Health-related signals (optional). For example: heart rate, recovery indicators, injury notes — if you provide or import them.
Purpose: Enable richer insights and personalization.
Lawful basis: Explicit consent where required for sensitive data; otherwise Contract.
5. Location / GPS data (optional). If you record outdoor workouts and enable permissions.
Purpose: Route mapping, distance/pace calculation, workout records.
Lawful basis: Consent (device permission); sometimes Contract (feature you request).
6. Connected services data (optional). Data from partners you connect (e.g., Strava, Garmin, Apple Health, Google Fit, COROS).
Purpose: Import/export workouts; consolidate your training history; improve personalization.
Lawful basis: Consent (connection authorization); Contract.
7. Technical & usage data. IP address, device type, OS/app version, language, approximate location from IP, server logs, crash reports, feature usage.
Purpose: Operate, secure, and troubleshoot the Services; prevent fraud/abuse; improve performance.
Lawful basis: Legitimate interests (security, improvement); sometimes Consent (where required for tracking).
8. Support communications. In-app messages where applicable, emails, bug reports.
Purpose: Provide customer support and respond to your requests.
Lawful basis: Contract; Legitimate interests (support quality).
9. Marketing preferences (optional). Newsletter opt-in/out and campaign engagement.
Purpose: Send updates, offers, and news (where permitted).
Lawful basis: Consent (marketing).
10. Subscription data. App Store / Google Play subscription status, receipt validation data, plan entitlements.
Purpose: Manage access to paid features and subscription status.
Lawful basis: Contract; Legal obligation (accounting where applicable).
Important note on sensitive data. Some fitness and health-related information can be considered "special category" (sensitive) personal data under GDPR depending on context. Where required, we rely on explicit consent and provide in-app controls.
CHAMA provides AI-powered coaching features. These features may process information you provide (such as your goals, training preferences, and workout summaries) to generate personalized recommendations.
AI Partner. We may use Anthropic as an AI processing partner to generate certain coaching outputs.
When AI features are enabled, we may share limited data with Anthropic that is reasonably necessary to generate the requested output (for example: plan structure, session summaries, distance/pace trends, your stated goals, and some wearable or health data made available through connected services such as Whoop or Apple Health / HealthKit). This may include workout history, heart rate, sleep, HRV, recovery-related metrics, activity, and similar fitness or wellness signals used to personalize recommendations. We aim to minimize the data shared and avoid sending direct identifiers where feasible.
In-app permission. Before AI features are activated, CHAMA asks for your permission in the app and explains what data may be sent to Anthropic. You can withdraw this permission at any time from the app settings; if you do, CHAMA's AI-powered features will stop working until permission is granted again.
Anthropic processes data for the purpose of providing the AI functionality to CHAMA. The handling of such data is governed by our contractual arrangements with Anthropic and applicable law.
Please do not include highly sensitive personal information (e.g., medical diagnoses, full address, or other sensitive details) in free-text fields unless strictly necessary, as free text may be used to generate AI outputs.
We do not use third-party advertising cookies or tracking SDKs for targeted advertising.
We may process basic technical data (such as IP address, device information, and server logs) to operate, secure, and improve reliability of the Services.
Where required by law, we will request consent before using non-essential cookies or similar technologies.
Corporate transactions. If we are involved in a merger, acquisition, reorganization, financing, bankruptcy, or sale of assets, personal data may be transferred as part of that transaction, subject to appropriate safeguards.
Aggregated statistics. We may use aggregated or de-identified data to understand trends and improve the Services. Such data is not intended to identify you.
We keep personal data only as long as necessary to provide the Services and for legitimate and lawful business needs (such as security, dispute resolution, and compliance with legal obligations).
You can request deletion of your account and personal data at any time by contacting support@hellochama.com. Some data may be retained where required by law or where necessary to establish, exercise, or defend legal claims.
We do not sell your personal data.
We share your personal data only with service providers that help us operate the Services, under confidentiality and security obligations, and only to the extent necessary for them to perform their services.
Cloud Hosting and Storage (AWS). Your data is hosted on Amazon Web Services (AWS) servers located in Europe. Data transmitted between your device and our servers is encrypted in transit using standard TLS/SSL connections.
AI Partner (Anthropic). If you use AI coaching features, we may send limited data needed to generate coaching outputs to Anthropic, under contract and for the purposes described in this Privacy Policy.
Legal and compliance. We may disclose personal data where required to comply with law, enforce our Terms, or protect rights, property, or safety.
We predominantly process personal data in France and/or the EEA. Some third-party providers may process personal data outside the EEA. Where we transfer personal data internationally, we do so in accordance with GDPR requirements, including using appropriate safeguards such as adequacy decisions or Standard Contractual Clauses where applicable.
We may disclose personal data to third parties where we are required to do so to comply with the law or lawful requests; enforce or apply our Terms; or protect the rights, property, or safety of our users or others.
In certain circumstances, and only at your explicit request and with your express consent, a CHAMA employee may activate a temporary User Account Assistance Mode to troubleshoot or resolve a specific issue.
When activated: access is limited to authorized staff trained on confidentiality; access is time-limited and restricted to what is necessary; we use appropriate authentication measures where feasible; and you may withdraw consent at any time.
We implement appropriate technical and organizational measures designed to protect your personal data, including encryption in transit (TLS/SSL), access controls, and security monitoring.
No method of transmission over the Internet or electronic storage is 100% secure. Therefore, while we strive to protect personal data, we cannot guarantee absolute security.
